Terms & Conditions

Effective Date: September 04, 2025

1. Definitions

1. Company refers to HK Services.
2. Customer refers to the individual or entity subscribing to the RO rental service.
3. Equipment refers to the RO water purifier unit, accessories, and TDS controller.
4. Rental Period refers to the agreed term (6, 12, or 24 months).
5. Maintenance refers to lifetime preventive service at no extra cost.

2. Payment and Refund Policy

1. Full advance payment is required before installation scheduling.
2. All payments are strictly non-refundable once received.
3. If payment is not received within 7 days of due date, the Company may terminate the agreement and reclaim Equipment without refund.

3. Installation and Cancellation

1. Installation is scheduled only after full payment clearance.
2. Once installation is complete, the service cannot be cancelled or refunded.
3. Each rescheduling beyond one request incurs a ₹500 fee.

4. Customer Responsibilities and Use

1. Installation Requirements:
   • Stable, level surface with proper water & power.
   • Adequate space, ventilation & correct voltage.
   • Licensed plumber must handle any plumbing modifications at Customer’s cost.
   • Equipment solely for potable water purification.
2. Damage Exclusions:
   • Accidental damage, misuse, or impact.
   • Short-circuits, voltage fluctuation, fire, flood, natural disasters.
   • Unauthorized repair or tampering.
3. Excluded damages are not covered under Maintenance; repair/replacement charges apply.

5. Maintenance and Service Visits

1. Lifetime preventive maintenance included during Rental Period.
2. Two free service visits per quarter; additional visits ₹250 each.
3. Consumables covered; misuse/natural disaster replacements charged at prevailing rates.

6. Equipment Ownership and Return

1. Equipment remains Company property at all times.
2. Customer must return Equipment within 7 days of Rental Period end.
3. Late returns incur ₹100/day; unreturned after 30 days deemed sold at 50% list price.

7. Liability and Indemnification

1. Company liability limited to repair or replacement of Equipment.
2. No liability for indirect, incidental, or consequential damages.
3. Customer indemnifies Company against claims from misuse or breach.

8. Force Majeure

1. No party liable for delays due to acts beyond control (natural disasters, war, labor disputes, government actions).
2. Affected party must notify the other and resume duties ASAP.

9. Termination

1. Company may terminate if Customer fails payment, misuses Equipment, or transfers it without consent.
2. Upon termination, Customer must return Equipment at own cost; outstanding charges become due immediately.

10. Governing Law & Dispute Resolution

1. These terms governed by Indian law; exclusive jurisdiction Vadodara courts.
2. Disputes to be amicably resolved within 30 days, then via arbitration under the Indian Arbitration and Conciliation Act, 1996, in Vadodara.

11. Miscellaneous

1. No waiver of breach unless in writing by Company.
2. Invalid provisions do not affect remaining terms.
3. Customer may not assign this agreement without written consent.

By subscribing to any HK Services RO rental plan, the Customer acknowledges they have read, understood, and agreed to these Terms & Conditions.
